Golf Carts of Isabela – Legal Agreement
LIABILITY WAIVER, RELEASE, AND INDEMNIFICATION AGREEMENTI, the undersigned renter (“Primary Renter”), acknowledge that operating or riding in a golf cart involves inherent risks, including bodily injury, death, property damage, collisions, overturning, weather conditions, mechanical failure, and the actions or negligence of other drivers, pedestrians, passengers, or third parties.I voluntarily assume all risks related to the rental and use of the golf cart. To the fullest extent permitted by law, I release, waive, and agree not to sue Golf Carts of Isabela, its owners, employees, affiliates, representatives, or agents for any liability, including negligence.I agree to indemnify and hold harmless Golf Carts of Isabela from any claims, damages, losses, expenses, or attorney’s fees arising from the rental, possession, operation, or use of the golf cart.I certify that I have a valid driver’s license and agree to comply with all applicable laws. Driving under the influence of alcohol or drugs is strictly prohibited.By signing this agreement, I acknowledge that I am the Primary Renter and assume full financial responsibility for the rental, regardless of who made the reservation, booking, or payment. This responsibility extends to all authorized drivers, passengers, minors, and occupants during the rental period.RENTER REQUIREMENTS1. Primary Renter must be at least 21 years old.
2. A valid driver’s license is required.
3. Only authorized drivers may operate the cart.
4. Additional drivers must be approved, registered, provide a valid license, and pay the applicable fee.
5. Primary Renter is responsible for all drivers, passengers, minors, and occupants.
6. All authorized drivers and the Primary Renter are jointly and severally liable for all obligations, damages, losses, fees, and charges incurred during the rental period.
AUTHORIZED DRIVER PER CARTEach rented cart must have one designated authorized driver assigned at the time of rental. This designated driver is included at no additional cost and is responsible for that specific cart.Any additional drivers beyond the designated driver must be approved, registered, and are subject to additional fees.Additional driver fees are charged at pickup at a rate of $10 per additional driver.PICKUP REQUIREMENTS1. A valid government-issued ID must be presented at pickup.
2. The card used for the online reservation must be presented at pickup and must match the name on the reservation and the renter’s valid identification.
3. The renter must present the original Debit/Credit card used for the reservation along with valid identification at pickup. Golf Carts of Isabela reserves the right to deny pickup or cancel the reservation if the cardholder, identification, and reservation details do not match.
4. A valid physical Debit or Credit card must be presented at pickup for security deposit authorization.
5. Golf Carts of Isabela reserves the right to request additional identity and payment verification before releasing the golf cart.
6. Failure to meet pickup, identification, payment, or verification requirements may result in cancellation of the reservation.
PAYMENT & AUTHORIZATIONRenter authorizes Golf Carts of Isabela to charge any payment method provided, including any card on file through Stripe, Square, or other payment processors, for all rental-related costs, including but not limited to rental fees, deposits, damages, fines, additional driver fees, late fees, cleaning fees, violations, towing, loss of use, and any other charges incurred.Authorized Charges:1. Rental fees and deposits
2. Damage or loss costs
3. Late fees and cleaning fees
4. Tickets, violations, towing, or recovery costs
5. Any charges incurred during the rental period
6. Excessive dirt, sand, trash, or abnormal cleaning
7. The person making the reservation confirms they are authorized to use the payment method provided.
8. Renter agrees that failure to pay any charges may result in additional fees, collections, or legal action.
Third-Party Payment Authorization:If the Primary Renter is not the same individual who made the reservation or provided payment, the Primary Renter acknowledges and agrees that any payment method used for the reservation may be charged for damages, fees, violations, or other charges incurred during the rental period.The Primary Renter assumes full financial responsibility regardless of the original payer.Payment Terms:Rental fees are paid in full online at the time of booking. No remaining rental balance is due at pickup. Additional driver fees ($10 each) are charged at pickup if applicable.Security deposits must be authorized using only a valid Debit or Credit card.Promotional discounts are only valid when applied during the online checkout process. Discounts may be applied in person only for walk-in customers who do not have an existing online reservation.RENTAL PRICING & FUEL POLICY1. Hourly rentals are $35 per hour, per cart, based on the reserved rental period.
2. Day Time Adventure Cruise rentals are a flat rate of $145 per cart. Customers may select pickup and return times within operating hours during booking. Selected reservation times are operationally binding and must be followed.
3. Moonlight Cruise Experience rentals are $99 per cart. Customers may select any pickup and return time during booking, but only the selected date will be used for scheduling. Pickup Window: 7:00 PM – 8:00 PM. Return Window: 10:00 PM – 11:00 PM.
4. Fuel is included for normal recreational use within Isabela’s designated low-speed zones and nearby coastal routes intended for leisure and sightseeing.
5. Excessive, abnormal, prolonged, commercial, or unusually high fuel consumption or vehicle usage may result in additional fuel or usage charges at management discretion. Management may determine excessive usage based on rental duration, distance traveled, operating area, and overall vehicle operation.
SECURITY DEPOSIT1. A $200 security deposit per cart is required at pickup.
2. The deposit is authorized/held in person using a valid Debit or Credit card.
3. The deposit is not charged unless charges apply and will be released after the golf cart is returned and passes inspection.
4. The deposit may be used to cover damages, cleaning fees, late returns, violations, towing, loss of use, excessive fuel or usage charges, or any other charges incurred during the rental period.
5. If charges exceed the deposit amount, the Primary Renter agrees to pay the remaining balance.
6. The Primary Renter authorizes Golf Carts of Isabela to charge any payment method on file for outstanding balances.
7. Authorization holds may take several business days to release depending on the card issuer or financial institution.
DAMAGE, LOSS & FINANCIAL RESPONSIBILITYRenter is fully responsible for any damage, loss, theft, reduction in value, or loss of use regardless of fault, including third-party actions, accidents, vandalism, unknown causes, or damage discovered after return if determined to have occurred during the rental period.Renter is responsible for, including but not limited to:1. Collision, tire, body, seat, electrical, or mechanical damage
2. Theft, vandalism, or total loss
3. Repairs, replacement, towing, recovery, administrative costs, and loss of use, including lost rental income while the cart is unavailable
4. Any balance exceeding the security deposit
5. Damage caused by authorized drivers, passengers, minors, third parties, or improper use
The rental of the golf cart does not create a bailment. The cart remains the responsibility of the Primary Renter at all times during the rental period.PROHIBITED USESThe following are strictly prohibited:1. Driving under the influence of alcohol or drugs
2. Reckless, careless, unsafe, or negligent driving
3. Operation by unauthorized drivers
4. Overloading passengers or exceeding seating capacity
5. Operation on highways or roadways where low-speed vehicles are not permitted
6. Driving on sand, soft terrain, off-road areas, or terrain where the cart may become stuck
7. Racing, stunts, towing, pushing, or intentional misuse
8. Illegal activity
9. Subleasing, lending, transferring possession, or allowing unauthorized individuals to possess or operate the cart
10. Operating outside Isabela’s designated low-speed zones and nearby coastal routes intended for leisure and sightseeing, including highways, high-speed roadways, and high-traffic zones
Violation of any prohibited use may result in additional charges, immediate termination of the rental, and full financial responsibility for any resulting damages, losses, fees, penalties, or claims.RENTAL TERMS1. Normal operating hours: Monday–Sunday, 9AM - 6PM.
2. Moonlight Cruise Experience hours: Pickup Window: 7PM – 8PM. Return Window: 10PM – 11PM.
3. Customer pickup and return is required unless otherwise approved by management.
4. The cart must be returned on time and in the same condition received.
5. Rental time begins at the scheduled pickup time selected at booking, regardless of actual pickup time.
6. The Primary Renter remains responsible for the cart and all authorized drivers for the entire rental period, regardless of who operates the cart.
7. Unused rental time is non-refundable.
8. Reservation times selected during booking are operationally binding and must be followed for pickup and return scheduling, regardless of whether the rental is billed hourly or at a flat rate.
9. Golf carts may only be operated within Isabela’s designated low-speed zones and nearby coastal routes intended for leisure and sightseeing. Operation on highways, high-speed roadways, and high-traffic zones is strictly prohibited.
PICKUP TIME & EARLY PICKUP POLICYAll reservations are scheduled for a specific pickup time selected at checkout. Customers must arrive at their scheduled pickup time. It is recommended to arrive 15 minutes early to complete waivers, verification, and vehicle inspection.Early pickup is not permitted unless explicitly approved by management. Availability before the scheduled pickup time is not guaranteed.Golf carts reserved for later pickup times may be rented to other customers on an hourly basis before the scheduled reservation. Therefore, the reserved cart may not be available before the confirmed pickup time.Customers requesting early pickup must contact management in advance. Approval is based strictly on availability, is not guaranteed, and may be subject to an additional fee.A minimum 1-hour preparation buffer is required before scheduled pickups to allow inspection, cleaning, and readiness of the vehicle.Arriving early does not entitle the customer to early access. Customers arriving before their scheduled time may be required to wait until the confirmed pickup time.Late Return Policy1. All rentals must be returned at the selected return time. Reservation times are binding.
2. A short grace period may be allowed at management discretion; repeated or unauthorized delays are not permitted.
3. Day Time & Moonlight Rentals
* 16–30 minutes late: $25 late fee
* 31–60 minutes late: $50 late fee
4. Hourly Rentals
* 16–30 minutes late: $20 late fee
* 31–60 minutes late: $35 late fee
* Each additional hour or portion: $35 late fee
5. Returns exceeding 60 minutes may result in additional hourly charges, full-day rates, overnight fees, recovery costs, loss-of-business charges, or other operational damages.
6. Unauthorized extensions or continued use beyond the rental period may be considered unauthorized use.
7. Failure to return the cart may result in additional charges, cancellation of future reservations, recovery actions, legal action, or reporting to authorities.
8. All late fees and damages are determined at the sole discretion of Golf Carts of Isabela based on operational impact.
ACCIDENTS / DAMAGEIn the event of any accident, damage, loss, theft, or incident involving the golf cart, regardless of severity, the Primary Renter and any authorized driver agree to the following:The Primary Renter must immediately notify Golf Carts of Isabela. Failure to report promptly may result in additional fees and full liability.Law enforcement must be contacted when required or when the incident involves injury, third parties, or property damage. A police report must be obtained when applicable.Renter and drivers shall not admit fault or liability. Fault will be determined through proper legal or insurance channels.The Primary Renter is fully responsible for all damages, losses, and liabilities arising from use or operation of the cart, including:* Vehicle damage (regardless of fault)
* Third-party property damage
* Bodily injury
* Theft or vandalism
* Towing, recovery, and administrative costs
* Loss of use and business interruption
Renter authorizes Golf Carts of Isabela to charge any payment method on file for all damages, losses, and associated costs not covered by the security deposit.Damage resulting from negligence, reckless driving, unauthorized use, operation outside permitted areas, or violation of these Terms may result in immediate termination and full liability.PERSONAL PROPERTYGolf Carts of Isabela is not responsible for any lost, stolen, or damaged personal property of any renter, driver, or passenger during or after the rental. All occupants are responsible for securing and removing their belongings. Any recovered items may be held as a courtesy, with no obligation to store, safeguard, ship, or return them.PRODUCT DESCRIPTIONS & CUSTOMER ACKNOWLEDGMENTThe renter acknowledges that all product descriptions, rental details, operating hours, pickup and return windows, pricing structures, restrictions, and important information are clearly provided on the website prior to booking.By completing a reservation, the renter confirms that they have read, understood, and accepted all product-specific details associated with the selected rental.Failure to read or review product descriptions does not exempt the renter from any terms, conditions, restrictions, scheduling requirements, or policies outlined within the product listing or these Terms & Conditions.The renter agrees that all product details, including but not limited to pickup windows, return windows, usage limitations, and operational requirements, are binding regardless of whether they were reviewed prior to booking.Golf Carts of Isabela is not responsible for misunderstandings resulting from failure to read or review product descriptions.In the event of any conflict or misunderstanding, the product description and these Terms & Conditions shall govern.

MECHANICAL ISSUESNo refunds or discounts will be issued for minor delays, interruptions, or inconveniences. In the event of significant mechanical failure, resolution will be at management’s discretion and may include repair, replacement, rescheduling, credit, or refund depending on the circumstances.WEATHER & CANCELLATION POLICY• Cancellations made 48 hours or more before the scheduled pickup time will receive a full refund.• Cancellations made 24 to 48 hours before the scheduled pickup time will receive a 50% refund.• Cancellations made less than 24 hours before the scheduled pickup time are non-refundable. Requests for partial refunds, credits, or rescheduling may be considered at management’s discretion.• Same-day cancellations, late arrivals, and no-shows are non-refundable and will result in forfeiture of the full rental payment.• Failure to arrive at the scheduled pickup time does not extend the rental period. The rental will still end at the originally scheduled return time. Late arrivals are not eligible for refunds, credits, or additional time.• If Golf Carts of Isabela is unable to fulfill a reservation due to severe weather, unsafe conditions, or other safety concerns, customers will be offered a full refund or the option to reschedule, based on availability. Any security deposit will be fully released.• Cancellations due to non-severe weather (including light rain, overcast conditions, or forecast uncertainty) are non-refundable. Rescheduling or partial credit may be offered at management’s discretion.• Reschedules require prior approval, are subject to availability, and may be limited to one-time use within a reasonable timeframe determined by Golf Carts of Isabela.• Approved refunds are issued to the original payment method and typically process within 3–5 business days, depending on the payment provider.• All cancellations, refunds, credits, and rescheduling decisions are made at the sole discretion of Golf Carts of Isabela.PASSENGERS, MINORS & SAFETYAll passengers must remain properly seated while the golf cart is in motion. Standing, riding on laps, sitting on the back, hanging from the vehicle, or any unsafe riding behavior is strictly prohibited.Children and minors are permitted as passengers only and are strictly prohibited from operating the vehicle under any circumstances.All passengers, including minors, must be safely seated within the designated seating capacity of the vehicle. Exceeding passenger limits or operating the vehicle unsafely is strictly prohibited.The Primary Renter assumes full responsibility for the conduct, supervision, and safety of all passengers, including minors, regardless of who operates the vehicle.Golf Carts of Isabela reserves the right to deny, suspend, or terminate any rental without refund if unsafe conditions are observed, including improper seating, lack of supervision, reckless behavior, or violation of safety requirements.VEHICLE PICKUP AND PARKING POLICYThe location is for pickup and return only. No parking is allowed during the rental period. Guests must arrange alternative transportation. Customer pickup only; no delivery available.INSPECTION & CONDITIONRenter confirms the cart was inspected and accepted as-is before use.Photos and/or videos taken at pickup and return are part of the official inspection record and may be used as evidence of the cart’s condition for determining damages, fees, and charges.

SEPARATE RESERVATIONS REQUIREMENTReservations with different rental dates, pickup times, return times, or rental schedules may be required to be processed separately at the sole discretion of Golf Carts of Isabela.Golf Carts of Isabela reserves the right to modify, separate, adjust, or cancel conflicting reservation schedules to maintain operational accuracy and availability.GPS Tracking & Vehicle MonitoringAll golf carts are equipped with active GPS tracking devices for security, safety, and operational purposes. By entering into this rental agreement, the Primary Renter acknowledges and consents to the monitoring and tracking of the vehicle’s location at all times during the rental period.GPS tracking may be used to:
• Locate and recover the vehicle in the event of theft, loss, or unauthorized use
• Ensure the vehicle remains within permitted operating areas
• Verify compliance with rental terms, including proper usage and time restrictions
• Assist in emergency situations or roadside support if needed
Golf Carts of Isabela reserves the right to monitor the real-time location of all vehicles and to take appropriate action if the vehicle is used in violation of this agreement, including but not limited to retrieval of the vehicle, termination of the rental, or additional charges.Any attempt to disable, tamper with, remove, or interfere with the GPS tracking device is strictly prohibited and will result in immediate termination of the rental agreement, forfeiture of payments, and may result in additional fees or legal action.INSURANCE DISCLAIMERNo insurance is provided. Renter assumes full liability.The golf cart is provided “as-is,” and operation is at the renter’s own risk.Renter is encouraged to verify whether personal automobile, liability, travel, or credit card insurance provides coverage for golf cart rentals.RIGHT TO REFUSE SERVICEGolf Carts of Isabela reserves the right to refuse, cancel, suspend, or terminate service for any lawful reason, including safety concerns, policy violations, failed verification, suspected fraud, or inappropriate behavior.LEGAL COMPLIANCERenter is responsible for complying with all applicable laws, rules, regulations, road restrictions, parking requirements, and operating limitations. Renter is responsible for all violations, tickets, fines, penalties, towing, and related costs.SEVERABILITYIf any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.GOVERNING LAWThis agreement is governed by the laws of the Commonwealth of Puerto Rico.CHARGEBACK & DISPUTESRenter agrees not to initiate chargebacks for valid charges. All disputes must be handled directly with Golf Carts of Isabela. The prevailing party in any legal action is entitled to recover attorney’s fees and costs.ELECTRONIC SIGNATUREBy completing a reservation, signing electronically, or accepting these Terms & Conditions, the renter acknowledges and agrees that such electronic acceptance constitutes a legally binding agreement equivalent to a handwritten signature.
